Consider The Consumer, the leading nationally syndicated consumer-fraud watchdog, reports that a class action lawsuit has been filed on November 22, 2016 against the popular watch brand, Invicta, for their allegedly unfair and deceptive business practices.
The Complaint was filed in The Federal District Court for the Southern District of Florida and alleges that the company represents its “Pro Diver Watches” as being water resistant at depths of 50-300 meters, and are appropriate for various types of water activities, when in reality, they are not. Consequently, consumers who purchased these Pro Diver Series watches have experienced condensation and bubbles under the watch face, and defectiveness caused by water damage after wearing the product in and around water. The claims of the proposed class members exceed the sum or value of $5 million dollars, and many watch-wearers now have damaged, non-functioning, watches for which they paid anywhere from $80 to $500.
